Cutler Praises Signing of Castle Doctrine Bill

Rep. Bryan Cutler (R-Peach Bottom) released the following statement regarding Gov. Tom Corbett signing House Bill 40, which is known as the Castle Doctrine, into law: 

“This legislation has been a top priority for a long time, and I am glad to see it finally enacted.  It is important to untie the hands of innocent victims when it comes to self-defense.  Self protection is a basic and instinctive right, and a person should not be held liable for taking action to protect the life and safety of his or her family or self when faced with a grave threat.”

“This law is necessary because without the protection of this act, an individual can be subject to a civil lawsuit for taking action to defend his or her own life.  The new law offers protection against civil liability for the lawful use of force in self-defense or in defense of others.  This means if a person uses lawful force against a violent perpetrator who in turn sues, the defendant in the case would be entitled to an award of attorneys’ fees, court costs and compensation for lost income if he or she prevails.    

“Another important aspect of the law is that it removes an individual’s duty to retreat before taking action in self-defense.  In cases of violent crime, it is unfair to ask a citizen to run away rather than face down an attacker.  The decision to fight is often instinctual, and citizens should have the right to self-defense without fear of criminal or civil reprisal.”
